i was out with my mum this eve. sat in queing traffic at the level crossing. The tain goes and the traffic moves on as we reached the line of the crossing the amber light comes on and the traffic on the other side stops. the front wheels of the car are allready over the line of the barrier. so my mum waits for a moment for the trafic to move. at this point im sure the camera flashed. the traffic quickey moves and as she cant back up because of the traffic she crosses. all this happens very quickley ie just as the lights change from amber to red and the barriers had not moved yet.

if the NIP comes through what the penalty be?

and to make it worse it will go to a mate of mine who has just moved house as i only bought the car for her a few days ago.

I thought if front wheels were over you're committed to proceeding and therefore ok?

IANAL.

You don't cross the line unless the exit is clear.

Driving on to a level crossing before you've got a safe route across is a very good way to end up a bumper ornament for a train. Anyone with any sense would wait until the traffic was clear on the other side of the tracks before proceeding.

well aware of this however in her defence the line and barrier are a long way fron the track so there was never a danger. the worse case whould have been the barrier would have come down on the car.

It depends on who's the camera is, some are NR's some are councils.

Fines can be high (in the 100s) but usually 3 pointers.

Same as for traffic lights - the offence is committed if any part of the vehicle proceeds beyond the stop line with the flashing reds showing.

Likely to be an offer of 3 points and £60.
