i live in london and pot holes seem to be everywhere its a bloody nightmare, thing is a pot hole has buckled my 18inch m sport replica alloy, as a result of that ive have to take them off my car as it seems to let air out every few days grrrrrrrr back to standard bmw wheels, anyway just wanted to know if i can sue the council or get some kind of reinbursement for this, they cost me 600 quid without tyres, what you guys think.

I believe that if it's already been reported you can claim.

But - imo - choosing to drive with massive alloys (i.e. when they're not standard fit) around these parts given the state of the roads is asking for it.

Isn't it the other way around? When they've been reported they paint a yellow line around them to warn you which would result in a claim being denied.

Winter has just about gone, and pot holes will be a massive issue now, but I have heard of someone suing the council and being reimbursed for the damages.

Not heard that one before confused

As far as I understand it, if it's been reported but not subsequently repaired, anybody who receives damage due to it is able to claim. However, you can't claim from damage for previously unreported potholes because the authority "wasn't aware of them", or words to that effect at least.

I might be wrong on this, if anybody knows otherwise please say! smile

Take photos of the pothole and damage to the wheel with a good camera (no blurry [hone camera crap) and call the council and ask how you can submit a claim. If you have no photos of the hole or if its been filled already the claim will be denied.

It's quite easy. Email the local council, they'll send you a form to fill out asking about damage and location.
I sent a receipt for the new wheel and tyre and a location marked on a google maps print out and a few weeks later, I had a cheque in the post.

I think what unfortunately what will happen is that you buy a new wheel and they don't give you a penny

Has been discussed many times before (do a PH quick search). There are certain conditions for claiming, some guidance here:

http://www.potholes.co.uk/

Presume you reported the hole after you hit it?

I doubt you have a chance in hell, done 3 20 inch wheels on my 7 this winter at £489 each !! And one tyre so about £1800 and did 2 last year tried in vain to claim even with solicitor ... Got no where.

Its then price you pay I am afraid for having big wheels
