On sunday,a old woman driver crashed through my boundary wall, damaging my sons car.
The wall will be repaired through my insurance company, who will claim back from hers.
Problem is the jeep has no insurance on it at moment as my son is saving up to get it on the road.
My insurance company said it cant put jeep through the claim because it is not insured.
If drivers insurance say the same thing im stuffed, this cant be fair surely.
Will i have to claim repair of her personaly, and if need be through the courts.
Advice needed.

Imo the other drivers car insurance "should" pay in a case like this, not your son.

The other driver's insurance is liable just like they are for the wall - you don't need to claim for the wall through your own insurance you're just doing so to get the job done quicker. (if you didn't have buildings insurance, would the wall still be fixed? yes it would)

They will definately have to pay for the damage. No questions.

What's the difference between it being a Jeep compared to it being a Grand Piano that you'd just bought and were in the process of getting into the house.

Tell her insurance company that if they don't start to help, you'll persue the matter through the small claims court.

She is liable - her insurers should pay out if you claim against them directly - but beware : http://www.pistonheads.com/gassing/topic.asp?h=0&a...

Thanks for advice, seems to me the insurance company policy of not dealing with any claim if
vehicle is not insured seems flawed, as if it is on private land it is still a item of value as is
any other item that has been damaged by other persons.

Just make a claim for it on the Biddy's insurance.
