Hi

About 2 years ago, i scratched a parked car. It was a minor scratch. I spoke to the owner and agreed to fix the car. They sent me 3 quotes and i agreed to pay the lowest quote (380 GBP) on condition that the matter would close there.
In a series of email exchanges the 3rd party (who is a solicitor) kept harassing me that i shud make the payment within 1 hour etc even though a bacs transfer would be 3 days and also said that my payment would not mean them not going to their insurance.
I then decided to tell them to go thru their insurance as it would mean i pay them and still not be sure to see the back of them.

I sent all this information to my insurance company and they acknowledged the exchange of emails and quotes giving my the 3rd party. They said they would get back if the needed more information.
After this i never heard from them again.

2 years later i get a notice from the insurance company notifying cancellation of the insurance due to non payment of excess.
My questions to them were
1. Why was i not notified of how much excess is to be paid
2. If the case was settled, why was i not informed of how much was to be paid.

The insurance company told me that they had a court notice to pay out and they paid out 2800 without looking at the evidence i sent.
Also they had no reason why they never informed me about the case being settled and that my excess was due.

My excess is 1500 and also they hv no explanation of how when the first quote was 380 they ended up paying the whole amout not acting in my interest.
The 3rd party could have damaged the car further and then claimed more.

I believe my car insurance company has not acted in my interest.

Is there any redressal available to me or do i just have to pay the whole excess??

Did you get your own car fixed?

I thought you only had to pay an excess if you claimed for repairs for your own car, not for third party liability?

FYI, no naming and shaming on PH, so I'd edit your post to remove the name of your insurer.

I removed the company name
I have a 3 party insurance only. I did not claim on my car as there was no damage at all.
If there is a claim made on your insurance ur liable upto the sum of the excess payable.

I've never heard of an excess on 3rd party insurance. Seriously.

I have FC insurance with a £750 excess - if I cause an accident and opt not to have my car repaired I owe nothing.

This is how it works

You have a non fault accident - ur car is damaged - U can claim on your insurance - this gets passed on to the other car driver. U need not pay any excess as its claimed back from the other insurance company.

If ur at fault, the other party claims on their insurance, it gets forwarded to your insurance company who pays them and collects your excess as it was an indirect claim on your insurance.

It depends on your policy actually, in most cases you only pay the excess if you want the damage to your car repaired.
There are a few policies out there with 3rd party excesses in which you pay an amount if someone claims against you, but I'd say they are in the minority rather than the majority.
Technically you're both right.

Yeah, they are rare, but .... interesting.

If the OP is female, then if it is the company I am thinking of have a £3000 excess for males !

They are not really a true excess, the insurer cannot refuse to pay the third party, but they try to make the payment to them a policy condition.

Can't see how you can pay if you aren't told. Did they write to you ? Have you moved ?

They had the new address as i had renewed the policy. the cancellation notice came to the right address. they had no indication or record of a note asking for excess to be sent on their system
