So am I being prosecuted for driving with no tax, or not?

Got a letter today from the DVLA that reads:

DVLA Letter said:

UNTAXED VEHICLE WARNING:[REG NO]
Our latest information shows that you have not taxed your vehicle and it has been seen driving at [name of road] on [date] at [time]

You may already face an £80 penalty or fine, or even worse, we could impound and crush your vehicle

blah blah about getting a tax disc and a bit about if the car isn't mine, who I sold it to...

Now I was driving a cat-c write off LEGALLY to a Pre-Booked MOT Test, prior to it's VIC check, and it was taxed immediately after the VIC, so thats fine, but do I just chuck this in the bin, or do I need to respond and tell them to go fourth and multiply??

Should I expect a fine to be on it's way aswell??

Write back with an enclosed copy of the MOT and even get the garage to write a letter confirming the car was booked in at x time?

But I don't think they are fining me or asking for a reason as to why, just advising me I might get fined and I need to tax my car, or that's how it reads?

If I get a fine/NIP/summons then it will all be going in the post to them...

with all the ANPR cameras about the first one is a warning, "you've been seen driving an unlicensed ar on the highway........this is what we CAN do"

2nd time, fine and flagged up on ANPR

Fair enough, worrying then because the one they got me on was driving to the MOT, i then drove from it to a place of repair, then back to it for a re-test, then away to a VIC check!

Looking forward to the fine....

Glad they are catching the scum that drive without documents though

Luckily, as it was all pre-arranged and the MoT place wrote down my appointment - as did the VIC venue - and the place of repair has records of my visit as well, I am fine....

Fixed that for you. Have fun in court with your boilerplate defence , should their idle threats get that far. They prefer that people "pay up" though (again, should it get that far)...
