what are the rules of having a closed cockpit.. I can see it being an advantage in some respects but they must have to comply to the GT rules for cabin temp ie a good air con system which would be added weight

I heard that the ACO are looking at all LMP1 cars being closed cockpit by 2010.

Yes, all LMP1s must be closed cockpit by 2010 which I assume is why Peugeot have developed the car in this way. Henri P is lobbying the ACO to change their decision and go back to the old system of having both open and closed. Watch this space...
