over 3 weeks after deposit paid and still no new car
Discussion
Hi - I'm getting a bit stressed out now as I've paid a deposit for a brand new Fiat Punto on St Patricks day ( 17 March) and the car has been registered to the dealers ( not to me) on 28 March - I've signed the finance deal ( which I didn't want to do ) but was told I had to. to get 'the deal'.
I'm now paying £1.89/day interest with no car and my 14 days withdrawal period is ending soon - I'm going to cancel as I didn't want the finance in the first place.
But what do I do now? The finance company will still want their money -and I don't have a car , but there is one stuck in Bristol with my name on it!
Any ideas as to what I do next? ( I have chased the dealers and it's 'in Bristol')

when did you received your documentation. What did the salesperson actually say to you, as anything thing he said could be misrepresentation if he advised you would be getting the car the next day etc.
if you feel umbrage ask to raise a complaint, if no resource raise a complaint with the Financial Services Authority

If you didn't want the finance why did you take out finance?
"We'll sell you the car without finance, but you'll pay £2500 more - just pay it off in the first two weeks and you'll still get the deal"However I'm not paying the full amount without a car to show for it! I'm going round the dealership tomorrow to check it hasn't arrived ( and they're not telling me) and asking where it is/ how much longer I'm going to have to wait for it.

When I ordered the car on 17 March - I was told it would be registered at end of March ( which it was 28 March), I'd be asked to sign the finance documents and then the car would be made available to me when the finance company had received and checked the paperwork. if you feel umbrage ask to raise a complaint, if no resource raise a complaint with the Financial Services Authority
I'm going to visit the dealership tomorrow and hope to get some answers then.

so you have paid all the money and you have no car?
What have the dealer said? I would expect to pay the funds a few days in advance so they can see its cleared and the finance to kick in on the day of purchase ie collection.
No I haven't - I've paid £600 deposit on 17 March and signed a finance agreement last week which is currently costing me £1.89 /day interest. I have 14 days from signing finance agreement to withdraw ( which I will be doing) but then have to pay the full amount c. £7500 straight away. I don't want to pay that without even seeing the car as it's registered to the dealership and not me. What have the dealer said? You thus should have the car in your hot sticky hands as the garage has got all of your money (which included the finance)
I visited the dealership this afternoon to ask when my car was due to be delivered - was told it arrived yesterday evening with a grey Punto that I knew had been sold prior to mine. I then asked to see it and was shown my car with my name on it. At least I feel happier about things now.
I collect it Monday afternoon as it needs to be plated, washed, checked over etc.
My plan was to withdraw from the finance agreement Saturday or perhaps it would be better if I wait till after I collect it Monday afternoon.

Well your 14 days to withdraw from the agreement expired 6 days ago, assuming you signed the agreement on the 17th when you ordered the car?I collect it Monday afternoon as it needs to be plated, washed, checked over etc.

Presumably he means to settle it, rather than cancel.condor said:

Apparently the forms I signed when I paid the deposit on Friday 17 March were to the garage agreeing to buy the car. The finance agreement I actually signed on 30th March is the one that gives me the right to withdraw within 14 days, but then I need to pay full amount to finance company. I'll ring them Saturday and find out the best way to settle up.
It's all very confusing, and for me that has only bought new once before 11 years ago ( when I chose the car and paid for it by debit card at the dealers) - I don't like the way you are forced to buy cars on finance nowadays.

I paid off the finance earlier today under the 'right to withdraw' - was very simple, double checked the bank sort code and account number to pay via online banking.
Not received a confirmation email that the payment has gone through though.
Bit surprised that it was a different bank sort code from the direct debit instruction, queried it - but seems OK.
Changed insurance details to new car for when I collect this Monday afternoon - I got stung there! A massive hike in insurance for the couple of months left on my existing policy and a £25 admin fee!
