Hello all! I've been lurking on the forums and site for some time, but I've finally made an account as I have a rather burning question that I'm stressing over. I placed an order for a new Kia on Saturday (I got a great deal, hence Kia and not a VW or anything like that). The model wasn't in stock so I agreed to wait for a new factory build; the dealer told me it would take 12 weeks (at most), but now I want to cancel the order outright. I paid a £500 deposit on my credit card.

I recently got a new job with a three month probationary period, but I was not made permanent with a pay rise on Wednesday as I anticipated, and I have not been told when my next evaluation will be. I jumped the gun WAY too early and I regret it immensely. I do not want to keep a new car order over my head (or, worst case scenario, loose my job and be forced to take a new car). Plus, a recent and sudden bill on my credit card has only compounded the problem.

I do not have a VIN number and I do not have a firm delivery date. I've signed a Vehicle Order form but not a finance agreement. The Terms and Conditions are full of terrifying legalese that doesn't help in the slightest! laugh

If I cancel, would I merely loose my deposit or will there be hell to pay?

I've bought the car through Jennings Motor Group.

Chances are you will lose your deposit. best thing is to talk to them, hopefully they will be understanding. Apart from the salesperson's commission and a bit of admin, I doubt they would have lost much. There is a thread about ask a car salesman anything on here, perhaps ask your question there.

I thought there might have been a standard procedure to it all, maybe some legislation. If not then yeah, I'll just have to phone and ruin the poor salesman's commission.

If the sale was done off premises/distance sale, wouldn’t he be entitle to get back his full deposit?

Yep, both the recent contracts I’ve had did include some sort of cooling off period too, even when done on premises. Are you financing with the manufacturer? There is a 14 day cooling off period for finance (though not necessarily for the order).

Read any paperwork you have to gather info and then just call them. Probably happens more than you think and is a much bigger deal in your head than their

Negotiate that they hold the deposit and you commit to buying once promoted if they suggest you loose the deposit. If they don't then its "only" £500.

This is depend on how Jennings motor group are as a company.

Worst case scenario you have lost your deposit, Best case you explain your situation and they give you the money back or they choose to hold the deposit until you are ready to order again.
