I have been looking for a Mercedes CLK as per my previous post with little luck, however this week i found a C220CDI sport coupe that ticked a lot of boxes, 07 with 88k from new and fully documented history (nearly all MB).
It was a part exchange at a main dealer (not MB), drove really well however on the way back from the test drive the engine warning light came on but was not in limp mode, they promised to sort it so did the deal and paid a deposit.
Was due to collect on Thursday then today but they now want around another week to sort issue as it now needs to go to a MB specialist as they cannot sort or clear the code.
For some reason alarm bells are ringing in my head, the car will come with a full 1 year warranty (no claim limit) but do I:
A) try and recover deposit and walk away as I have no wish to buy a car with issues
or
B) let them sort repair as required and proceed with the sale.

It's a good sign that they are sending to MB or a specialist to resolve the issue instead of finding a way to clear the fault for a few days.
Personally I'd ask to see the V5, make a note of former owner and asl them some questions.
Then again personally I wouldn't be buying an 11 year old car from a dealer

Exactly this, many dealers would just clear the code and hope it doesn't come on again.If the fault returns within the first 30 days you have the car you can demand a full refund, or just give it back to them to repair.
