Cancelling an order

Just looking for people’s thought on this.
Since ordering my Leon 1.5tsi deal I’ve come to learn about the issues on this engine which I wasn’t aware of beforehand that VW have acknowledged but have no current fix for.
Referring to jerkiness and loss of power at low speeds and even cutting out.
I have Sounded out cancelling the car for these reasons (factory order no build date yet)
I’m Being told I’d be charged a “full cancellation fee”
The Dealer is willing to find a different model without this engine but obviously the cost is way up on the pricing I ordered at which I guessed it would be and is now no longer even an ok deal.
I personally think I have enough justification to be able to withdraw from the order without a any penalty due to the issue being acknowledged by VW and that the car currently doesn’t exist and has no build date as yet.
Only paperwork signed so far was the order form which does state that they reserve the right to charge an admin fee if the order is cancelled.

Does the order form give you the right to charge them an admin if they cancel the order?If not, and the contract allows them to cancel for any reason and without penalty, then it could be the contract is unfair as it's not balanced. That's illegal. Enforcing it might be tricky though.

I spoke to the contact I have at the dealer today after some to and fro via email and noted that the configurator online no longer allows you to spec a 1.5tsi of any combo.
I was told that this is a glitch on the site.
I’m wondering if this engine is headed to a “dieselgate” style situation.
If a fix was forthcoming I’d not be as concerned but as yet it seems VAG are scratching their heads or know that they can’t cure it.
Looks like I’ll just take the car and if there are issues that can’t be resolved I’ll be going down the rejection route.

Loads of cars have been rejected. It's a massive issue across VAG marques and VW don't seem to know how to fix it. VW have tried several software updates but the problem seems more fundamental than that. I've seen some suggestions that a redesigned cylinder head was supposed to fix it, but hasn't.

I’ve read on some threads that it may be possible to map out?
Problem then being a voided warranty and violating terms of the lease.

Thankfully the new SEAT Ateca we have in the family has the lovely little 1 litre engine but we'd originally settled on the 1.4 but that was being changed to 1.5 and availability was uncertain and we needed the car quickly. So I've been watching people on an Ateca forum get increasingly frustrated, some rejecting cars, others in courtesy cars for months and others being told they're imagining it and there's no problem.
