Hi, everyone!
I have a big question!
​​​​​​​ Is anyone can help?
i have bought a car on eBay as Cat S. Applied for logbook as the car was written off, but DVLA sent me a letter saying that they can not issue me a logbook as this car has been categorised as Cat A or B and must be scrapped.
I contacted DVLA, they sent me to any insurance company who has an engineer to perform a vehicle check to clarify the Cat.
I called RAC engineer, but i have been told that they are not allowed to perform checks on Cat A or B vehicles!
I know someone did change the Cat on the car through the insurance, but in my case i dont even know what is the name of insurance that Categorised this car as Cat A or B.
Does anyone knows how to help in this situation????

If the car is a Cat A or B then you cannot put it back on the road legally. You can use it for anything else that isn't road use such as track car, demolition derby or a nice garden monument.

If you do drive it on the road then you are doing so illegally. If you bought it from a company then you might be able to get your money back but the chances are really slim.

Thanks a lot for your reply, much appreciate it.
I am sending the seller the complain on the mis-discribed goods sold and asking for full refund as i have been advised by consumer standard agency and trade standards. Will see how that goes. Will keep you posted.
I was wondering if you know a good tool on DVLA website that will do HPI check for a car,so i can use in future, thanks a have a good evening.

HPI checks need to be paid for (about £10) so only worth doing when you have agreed a deal on a car

If you buy from autotrader now it will automatically flag up if it's a write off , however it isn't as good as a full hpi check as doesn't cover stuff like finance.

It also relies on them being accurate with the registration. I HPI check every car I buy irrespective of value for peace of mind, if you know someone who works in car sales they also may be able to do it for you for a pint.

Hope you get it resolved, a car of presumably low value would not have been repaired by anyone if it was genuinely smashed to pieces which the category would suggest so hopefully an admin error.

You can, there is nothing legally stopping you, but they can only be sold to approved repairers in first place. The op should have recourse with the ebay seller if it was listed as d and wasn't.

HPI check misses many of the crashed and un registered write offs on the market.
vcheck.co.uk covers more of these.

Are they a trader? I would also try with the Consumer Protection from Unfair Trading Regulations 2008 , misleading omissions ,as failure to follow act is a criminal offence not just civil.

I'm suprised trading standards didn't advise you off this, as they are the enforcers of this generally as well as Cat a and b can only be sold to registered repairers..

Guys, you are amazing! Thank you so much! Great help as i felt like noone cares, called police, they wont even log a report, saying its civil case.
Called eBay, as i left bad feedback but they removed my feedback as i put word dishonest!
Trade standards only said i should write him a letter ask for refund as he provided misleading information on the car. Now, i got email, trade standards gave me a Ref number, probably is a good sign.
On the listing said no PayPal or any other but cash or bank transfer, i saw pictures, spoke to the guy & paid bank transfer. Also, called my bank, reported the seller as a scam & they are investigating it now. Bank said, they will notify the reciever bank that it was a scam transaction & i gave them the reference number that trade standards issued me with, so will see what will happen.

Also, sent letter to him as trade standards said & to DVLA explaining the situation & asked to refund me £25 for logbook fee as well as road tax.
Fingers cross, but the hope is small.

Unless you take seller to small claims court and can prove he was dishonest and knew about it then you would be very unlikely to get any money back, I'm afraid.

DVLA will no longer issue V5s for Cat A / B so you can't get them back on the road.

is the seller listed as a trader on ebay? The thing is cat a and b can only be sold to registered repairers so he most likely knew . Like i said if he is a trader,

omits material information that the average consumer needs, according to the context, to make an informed decision about a transaction''

Remember this is much more useful than smalls claims, and is criminal not civil as i stated before. If will be a fair better motivating tool than small claims at this moment.

The issue is they aren't because it is just too uneconomical to repair and get recertified. Adrian flux offers insurance for cat b cars..

But in addition, DVLA will no longer issue V5s - so now you really can't.
