Am I right walking away from this?
Discussion
I've bought cars for years and years and never had a problem.
Found a beautiful, low mileage and well priced Jag XF the other day. Put a £99 deposit to reserve it, with a view to go and drive 3 hours tomorrow to pick it up.
The mileage was very low, but it was only 18 months old. The pictures and video seemed clean, salesman friendly etc. It was one of these 'car supermarket' style places, which I usually avoid like the plague, but this car ticked all the boxes.
This morning, I had a bad feeling. I've never bought a lemon before, but something screamed at me to check it out.
I chucked £20 at a HPI and found out the car still has outstanding finance with BMW Financial. I rang them but they refused to tell me anything for data protection.
I'm waiting for the garage to ring me to get my deposit back and tell them to f
k off.
I'm right in walking away from this aren't i? It's a shame because it was a beautiful, impeccable car.

Is the car a lemon then, or is there another problem with it?Found a beautiful, low mileage and well priced Jag XF the other day. Put a £99 deposit to reserve it, with a view to go and drive 3 hours tomorrow to pick it up.

It's common when cars have outstanding finance on them for it to paid off when ownership changes. If it's at a car supermarket, it might be the dealers stocking finance that is being shown up against the car
You say that you've bought cars for years & years, so surely you would be well versed in such situations by now?

This really is a non issue call the garage get them to sort the finance, it may mean you collect it next week rather than tomorrow.
As above why wouldn't you HPI a car before or during the viewing, you'd have saved yourself this thread
if I read the OP right he has not actually seen the car yet........As above why wouldn't you HPI a car before or during the viewing, you'd have saved yourself this thread

Not sure why you think it’s a lemon.Found a beautiful, low mileage and well priced Jag XF the other day. Put a £99 deposit to reserve it, with a view to go and drive 3 hours tomorrow to pick it up.

Just phone the dealer and ask what the deal is with the finance. If it’s a big car supermarket, they’re not going to sell you a car with a load of finance outstanding on it - not worth it to their reputation.
The only thing in your post that raises is an eyebrow for me is why an 18 month old car with low mileage that’s impeccable is in a car supermarket and not at a main dealer as an AUC.
But that can happen from time to time.

Who runs a HPI check before seeing a car?
Personally I go see the car before paying for a HPI check. It would get very expensive if I paid for a HPI check for every car I've walked away from due to issues with the car.

I do every time as it helps me decide if I want to view especially when I've discovered that the cars a Cat'd car but the advert doesn't list it as such.Personally I go see the car before paying for a HPI check. Who wants to travel a distance & then find out that plus three cars for £20 isn't a mad expense.
I don't know how many cars a car supermarket has in stock at any one time; let's say 200.
Average price? Let's say £15,000.
That's £3m tied up in stock. Not many car dealers have the much of a float. It's on finance to the dealer/supermarket, and it'll clear as soon as you pay for it.
Equally, I very much doubt the supermarket bought it without running check themselves first, or they'd be losing cars/money hand over fist.

Only once have I walked away from a car that was tied to finance and the owner had been deceiving about it.
I've walked away from tons of cars due to poor condition, accident repairs or not as described. Nothing that a HPI check would throw up.

Why do you think that it having a finance marker makes it a lemon? Found a beautiful, low mileage and well priced Jag XF the other day. Put a £99 deposit to reserve it, with a view to go and drive 3 hours tomorrow to pick it up.

The car may only have arrived in to stock this week, by the time the settlement is paid and then the marker is lifted, these all take a bit of time to action.
Sounds like buyers remorse more than a lemon to me.
Buyers remorse before you have even bought it.
More than likely, the car is new stock and finance has been cleared, but these things can take time to filter down to HPi.
Ask the dealer for proof of finance clearance, they should be able to provide evidence of this easily.
Or you could just tell them to f
k Off as you so politely state, in which case, I hope they boot you off the premises with a muddy size 9.
HTH.
