What are my rights if the broker/dealer cancel my order?
Discussion
Hi all
I'm hoping a fellow PH'er may have some more technical expertise/experience regarding the situation I find myself in. Apologies in advance for the long post.
I ordered a CLA 35 Premium in June 2019 with expected delivery in Nov 19
In that time I was advised of multiple delays (numerous excuses given) - first to Jan 20 then March 20 and the latest being September 20.
My order form with the broker (submitted in June 19) stated that orders could be cancelled if there was a price change but also stated the terms of the finance agreement over rode the order form.
I signed my finance agreement with the funder in July 2019 and there are no terms included in that which allow for cancellation/amendments should there be price rises from the supplier (ie Mercedes).
In December 2019, Mercedes slightly tweaked the Premium pack and raised the price of the car by a few grand.
Hitachi/Broker want Mercedes to honour the original price which they won't.
Am I correct in thinking that there is still an obligation to provide me with the car on the originally agreed terms?
If so and they are refusing to do so, who would be the relevant authorities/regulators to complain to?
