Hi All,
I have been in dispute with a car dealer who sold me a faulty car. I had the car checked by an independent mechanic at a good garage company and he said it wasn't fit for purpose. I returned the car then within the 30 day consumer rights period and requested a full refund.
They said they wanted to get it checked by their mechanic which is fair. I haven't heard back from them since then BUT the car is for sale on the dealer's website. They haven't refunded me or contacted me at all.
What is my next move as this can't be legal can it? I just want my money back!

I will go down there if necessary, leaving that to last as I'm currently sans vehicle and don't fancy public transport just now.
In the meantime I've been on to citizens advice who are now apparently going to contact trading standards because of the fact they've put it on sale. It would be so much easier if they'd just do what is right and refund me - why they want to go through this annoying charade I have no idea!

You needed to grow a set first and go down to see them before you did anything else IMO

The car being back on sale works in your favour as it shows that they have accepted your rejection of the car.
The dealer can't now say that they reject your rejection, and that you need to come to collect your car from them.
Your problem is now extracting your money back from the dealer. The car is no longer your problem because you have rejected it, and the dealer has seemingly accepted your rejection.
Forget about the car, as it is no longer yours. Focus on the matter of getting your money back.

To be fair, the dealer is ignoring calls and emails so he hasn’t got much of an option. Depending on the value of the car, the dealer is unlikely to have the cash in hand so he needs to determine how long he has before seeking court action.
Tesco don’t wait until they’ve sold some more stuff before refunding you, so why should a car dealer get away with it.

I would say, you are probably right at the bottom of the priority list right now.
Back to work with reduced staff, tonnes of enquiries to catch up with, cars to sell, clean advertise and photo etc, and a screamer dictating he wants his money back.
Pop and see them and ask when you can expect refund to be processed.

I do have the option of doing a section 75 or a charge-back as it was on credit card. Ironically I was avoiding that as it can cause big credit problems for the dealer. But I guess they want to be difficult so that's what they'll get. Officially the car really belongs to the credit card company so they can deal with them.

Unbelievable the hassle you'll go through without actually talking to them first. Its nothing to do with the school yard, its beyond belief you'd start the process of a trading standards complaint and consider chargebacks etc and go to all this effort without popping in to the dealer for a civil conversation first to see what their intentions are.NewUsername - strange and aggressive way way of approaching things I think. Unless there is stuff you aren't telling us ( like you live 300 miles away or you've phoned them 400 times and its been going on 3 months) it's just a very very weird way of dealing with it.
