Problem with sold car to dealer

I’ll try and keep this as simple as possible

A family member sold a car to one of these We Buy anything companies (not WBAC) he agreed on a price, lower than he wanted. Anyway he let the car go but the money would be transferred in 3/4 working days.

He bought another car In the meantime, and now they’ve messaged him offering him a lot less citing other problems.

Agreed price was £4,850 now they’ve offered £3,000.

They said he can accept the lower offer or they’ll return the car less £400 transport fees and storage costs.

I’m just wondering if this has happened to anyone else and what options he has?

Sounds pretty dubious practice, I've used WBAC and We Want Any Car in the past and both have paid straight away, We Wanty Any Car was actually the better service.

They sound like crooks + the "other person" has been a bit dumb in just carrying on without waiting for cleared funds!

Yep, sounds like they are crooks. Just checked out the company and they only started trading in Dec last year.

They said he could have the car back but it’ll cost £400 in transport + storage fees!

Without reading the contract I’ve said he’s basically got 2 choices. Either accept the £3k or go through the small claims process.

He doesn’t have a lot of money so doubt he’d try to sue them unfortunately.

What are they claiming is wrong with the car and was the seller aware of the problems?

There are issues with the car, it’s a BMW 135i, it had the wastegate rattle problem, an oil leak and needed near pads.
He was upfront about the problems, which was reflected in the lower than market price.

They are saying it’s blowing white smoke. He sold it from he’s work address and has CCTV footage of it driving away with no smoke.

Asking for storage costs is a bit rich. If contract doesn't say otherwise, tell him he will collect it from the same place they picked it up and not paying a penny

This. A refusal on their part and I'd involve the Police.

ETA: subject to seeing the contract, that is.

Well, it looks like he going to accept the lower offer.
Contract states that they can amend their offer once they’ve inspected the car (although I’d argue they inspected it before they drove away) and they sent him a video of the car with a load of white smoke coming out the exhaust.
