Selling a car and putting a reg on retention

Morning all,
Hopefully someone can help? I have had an offer on a car which I am selling which I have accepted. I have gone to put my private plate on retention at the DVLA but I am getting the below message: -
"You are unable to continue with this application online.
We need to look into your application further due to the vehicle’s licensing history.
Please send a V317 application, and the V5C registration certificate (logbook) to:
DVLA personalised registrations
Swansea
SA99 1DS
All documents must be originals, not photocopies or faxed copies."
No probs, I will send it in but it will obviously take a couple of weeks to get it back. The person purchasing the car is happy to take it with just a receipt, leaving me to do the V5 parts when it turns up. He has asked for me not send everything off yet so he can tax the vehicle when he collects it. I then send it off and re-register when it comes back through the door.
Two questions: -
1. Is that legal?
2. Could I be burned in anyway? I ask as the reg is worth about 3 times the cars value!
