I have bought a 2017 BMW 520d that I had delivered last week.

The car was described in the advert as ‘immaculate’ and as per lockdown rules I didn’t see the car before taking delivery (stupid yes)

In my 6 days of ownership the key fobs have both fallen apart, the EML is on, the blades have fallen off the heater vent, the NSR tyre is near the legal limit and the drivers seat is loose and moves around under braking, also the tyre pressure monitors are faulty.

I returned the car to the company I bought it from today and left it informing the salesman I was returning the vehicle, he said the service manager would call me.

Having paid a deposit and the rest taken on finance am
I entitled to return the car and end the finance?

Consumer Rights Act 2015

your contract is with the finance company (I assume you have a contract to pay a finance company £x a month).

You will be looking to reject on basis its not satisfactory quality. lots of guidance online as to what that may mean.

If you bought the car without any face to face meeting with the trader you may have 14 days from delivery to cancel with no reason and only be charged for your use. this may be an easier route as you don't have to base it on any specific reason. this would be classed as a distance sale and depends on the trader offering to sell cars by distance in an organised way

Citizens advice have a free consumer help line it may be worth asking for advice.

Yes you do have a right to return the car and I would imagine they used this as a feature to sell the car to you at distance when you bought it?

I have been of the opinion though that when it comes to trying to return a car most dealers are not going to make it easy and straight forward as they would like you to believe.

Was it a big dealer chain, main dealer or a smaller independent?

I returned a nearly new car to a dealer last year over lack of service history

It was nearly new, they were absolute tts about it, but of course they forgot they were the ones who had lied to me over the paper work

Make notes of every call, email etc with precise times.

You can return it within 14 days for a full refund. They shouldn’t even quibble this.

Between 14 and 30 days you can still try and return but give the dealer one chance to repair to your satisfaction.

There is a large BMW car supermarket in Kent that would consider those faults par for the course and you should think yourself lucky they have chosen you to be the lucky buyer of their unseen auction purchase that has been abused to within an inch of its life, tarted up and sold to an unsuspecting buyer.


On a serious note, yes you have every right to get a refund was others have said above.
