Cancelling overdue car order
Discussion
Like many people the car I have ordered is stuck due to the chip shortage.
The car is manufactured and delivered and is waiting a PDI and some revised parts to be fitted but its been like this for over a month now. The dealer can offer no updates and the manufacturer just says "Its due at the dealer next week" whenever I contact them. There is no eta on these parts it could well be months.
The car is currently 4 weeks overdue (Due 19th July) and I have decided to wait another two weeks till 1st Sept and then cancelling unless I get a firm delivery date or loan car
The order documentation I have offers no advice re-cancelling in this kind of situation so I assume we fall back to what is reasonable in law ie is not reasonable for an order to be delayed with no firm delivery date
FWIW I paid £1000 on a credit card for the deposit
I have already emailed the dealer stating that I will consider cancelling the order if no delivery on the 1/9/21 but further to that would it just be a case of doing this via email/phone
Anything I should consider when doing this ?

OP what did the seller tell re delivery dates when you placed the order?
More importantly, what does the written sales contract say?If it's only waiting for things which are to be bolted on later why can't you take delivery now on the understanding the dealer will have the car back to upgrade once the bits and pieces are in stock?

Order stated delivery date 30th July. Cancelling for me will be cancelling and not seeking to order another car at a later date
I appreciate its one of those things and in no way do I blame anyone but I see no point in waiting with no end in sight
I think if the car is built there is an end in sight. I would guess the parts aren't that far away. I know some manufacturers are sticking things like alternative amps in until the correct items are available. The fact they're not doing this suggests they expect the parts to arrive shortly.
It's unlikely the car would be built with something so fundamental missing it can't be resolved within a shortish period.
Very frustrating but as others have said if you were to cancel then you might be waiting a long, long time for an alternative if you did decide to reorder.

Not sure I understand that view tbh... you clearly want the car (as you ordered it) but don't need it (as you're prepared to cancel the order and not order another) and they are only holding £1000 (small beer in new car terms) so why not just wait?liner33 said:

I think you've done the right thing giving them what sounds like a reasonable deadline and even though the small print prob says something like "time is not of the essence" it's clear that you reasonable expectations re delivery will not have been met once it's (say) a month overdue.Cancelling for me will be cancelling and not seeking to order another car at a later date

As another poster mentioned the dealer will probably be happy to have a new car in stock that he might even manage to sell on for a cheeky premium in these strange days.

If I was to wait for much longer I would have potentially ordered a different model or even different make entirely Dan W. said:
Im sure the dealer will be happy to cancel your order and issue a refund, like a previous comment said cars are hard to get hold of and they wont have an issue selling to someone else.
we are upto 6 months for pretty much any new car now
Dan, Just wondered what marque is only 6 months. I've ordered at 12 months delivery time and some I've heard have stopped taking orders altogether. Is it the amount of electronic tech involved in the car? ... or just a matter of scale of manufacture - Jap verses EU/GB etc? (I know 'nout - not trying to catch you out!).we are upto 6 months for pretty much any new car now
