BMW Approved Used - MOT advisory

Hi all,
On Monday I found a lovely 2019 BMW X3 (G01). The car appears to be in great condition, with low miles, etc. and I received a decent offer on the car I will be trading in (compared to what other garages where offering). No money has been exchanged yet except for a reservation fee that’s refundable.
The car in question was overdue its MOT, and it is going to be its first one too. The BMW dealership mentioned it will pass through no problem due to its condition, mileage, etc. They told me that it will be going through its MOT today. Just checked online to see the result, and surprisingly it’s already available. It passed, however with an advisory for “ Offside Rear Tyre worn close to legal limit/worn on edge (5.2.3 (e))”. I checked the tyres on Monday, and they appeared in decent order, but obviously my “checking” is a lot to be desired!
My question - as it’s an “Approved Used BMW” would it be fair to say the car should not have such an advisory and come with decent tread depth on all four corners. Perhaps they replaced the tyre, but I doubt it. If they haven’t, would it be worth renegotiating even through I ‘shook-on’ the agreement to buy the car? I wouldn’t mind so much, but they are not cheap tyres plus the weather not being great this time of year. Supposed to be picking the car up tomorrow afternoon. What would you all do in such a situation?

In any case, I would use the MOT advisory as a discussion point with the dealer if the tyre hasn't already been changed, but if I really liked the car, I don't know if it would be a deal breaker for me for the sake of £150.
You're right, if it's approved used the tyres should have at least 3mm tread (unless they've changed it since the below).
Legal minimum is 1.6mm, so if it's worn close to that then it's likely below 3mm.

I had an MOT done at a BMW main dealer a couple of years back
Got advisories for two rear tyres
Both tyres had over 3mm on them, I also got a video health check and a tick box where I could authorise them to replace with two VERY expensive tyres sent to me
I would certainly have a good look at the tyre but I’d take advisories like that with a pinch of salt tbf

Perhaps a more interesting question is why the tyres are significantly worn on the inside edges (assuming the bit you saw looked fine). The tyres may need replacing, and if you are lucky perhaps the dealer will do this, but is there another issue with wheel alignment or worn suspension bushes that are causing the issue? In your position I would like that to be at least investigated before putting new tyres on, otherwise they will likely go the same way.

I called the dealership this morning. They are replacing the tyre that matches the others (Bridgestone)). Didn't need to ask, they were already planning on doing it, just needed to order the tyre in.
So all good. Nit-picking I would prefer if they changed both tyres on the axle, but that's perhaps being 'unfair' to ask.

I've just bought an AUC G01 M40i and was told that if there were any advisories on the prior to collection MOT, that they would be sorted and then a 'clean' MOT would be issued.
I'd definitely speak to the dealer and ask them to replace the tyre. See if you can also ask them to replace the nearside rear so tread depths match....

It would be ideal to have both rear tyres changed at the same time so it may be worth asking if they could give you a good price to change the other one. It may be too late to get it done at the same same time but you could arrange to drop in with the car in a few days and have it changed while you wait. I would prefer if they changed both tyres on the axle, but that's perhaps being 'unfair' to ask.

Same make and tread pattern
No more than 2mm difference in tread depth between tyres on the same axle
No more than 2-3mm difference in tread depth between tyres front to rear
Tyres with most tread on the rear
If you have any transmission / x drive issues they will check the above first !
Just changed all 4 tyres on the wifes x1 yesterday !
