So I bought a Mini Cooper s in July from a little mini specialist small individual garage and since then I haven’t had even 4 weeks of being able to drive it , it’s had so many issues it came with 2 years gold warranty so I kept taking it back 40 miles round trip and leaving it for him to fix which would take him weeks he says it had 2 new cylinder heads as they were cracked and a new timing chain but picked it up Friday and now it’s backfiring and the inside smells of petrol also when I moved the car it’s got petrol on the floor underneath he now wants me to take it at my expense to a local mechanic and get it diagnosed I am not willing to do this am in my right to ask for a full refund and expenses of me going backwards and forward

Go for a refund, you can bring up the expenses, to make more of a point, but not sure he'll pay them.

Go for the refund & push the expenses as leverage but don't expect to get those back, if they're a specialist you may find them more receptive to you taking a slightly more expensive version of your current car from their stock,

Spoken to him and he’s saying no money in budget asbb be it’s December for a refund as he’s a one man band so now what do I do

Solicitor > Small claims court (depending on how much you paid, I assume it's 4 figures)

Rules are different buying from a private individual, though car must be as described in ad. How old is the car?

Well, I would have thought the terms "mini specialist" and "small individual garage" would make it fairly clear that this isn't a private sale but, whatever puts your mind at rest.

Hi Einstein, try reading the entire thread first before making comments that make you look like an absolute pillock. The OP has stated that the one man band hasn't got the budget for this as it's December.... does that sound like A, a private seller, or B, a small mini specialist garage operating as a business?

I was ashamedly being a little facetious but being as you can't identify that and are seemingly on a mini-crusade to prove that your original point is valid, we'll just leave this here.......

So he’s a business but it’s just him and his wife , he buys and sells r53 minis mod’s them and sells them I have lost all faith in him so would not have anything else from him although the stock he has is a lot more expensive than I paid

You need to formally reject the car in writing and leave it at his premises.

If he refuses to refund you following that, engage with a solicitor and go down the legal route.

How did you pay for the car?

No such thing as a private specialist selling a few cars - thats called being a trader whether you like the desription or not.
