Hello all

Looking for advise, I recently bought a brand new Skoda Kamiq which I have, now regarding the deal, as my part exchange & the manufacturer's deposit contribution exceeded the max amount you can put down it was agreed that the order/offer is based on £4,000 cashback (email from salesman, signed off by Sales manager and deposit refund form confirms this) they have emailed me saying they have made a mistake and want £1000 back, where do I stand, do I need to pay it back.

That's rather interesting.

If you'd sold a used car on AT and decided it was discounted too much then could you imagine.

I'd be seeking free servicing as a minimum if they want this back.

If it was the other way around, I’m pretty sure they wouldn’t give you the £1k back. ‘I signed and paid for £20k, sorry I meant £19k, my mistake could you refund it please?’

I’d be telling them to jog on.

Imagine it the other way around, that you now consider you made a mistake and your trade in was actually worth £1000 more than agreed in writing. Would they be likely to entertain refunding a £1000 to you if you asked? Of course not.

Politely decline their request and move on, as they will have to.

Just never ever, ever have to pay for any work there because they will over the next few years add 10% or find extra work that needs doing...

As others have said politely tell them to trot on. You’re not obliged to send them anything.

Why exactly do they want the £1000 back??

What exactly was their mistake?

The only time I've ever heard of a dealer doing this kind of thing is where a part exchange was miss described.

The only time I've ever heard of a dealer doing this kind of thing is where a part exchange was miss described.
I think they cocked up there cost ro change, the salesman did not really know what he was doing, part ex they are selling on there forecourt, it's actually better than described as I got its 30k service done(existing kia service plan) they said no need and it's 100% as described and even come in under mileage as had to wait for my new car.

So if they continue to pursue this, tell them you'll be contacting the FCA for advice. (presume you've taken finance)

Then I see no reasonable reason that they're asking you to pay for their mistake.

If they continue to pursue this, tell them you're going to take advice from the FCA (presume you took finance with them)

Already have a service plan, but good idea.
Not sure a free service is a good idea if you actually want the job done well.

I presume that you have all the paperwork, invoices etc that confirm they have made the error?

I.e. sale and purchase agreement that says something like

cost of Skoda £35000
Less
PE Kia. £14250
deposit allow
FromVWFS. £2000

VWFS Finance. £22750

balance due to. £4000
MRxxxx

If they have made an error in their maths then that is their problem not yours

The dealer appears to have made an error in their maths and now wants £1000 from the OP. The OP has the car in their possession and thus is under no obligation to give the £1000 - although IANAL!
