[Luckly] it was the voyager. Made a mess of it though. Happened pulling out of my road when a grandad coming from my right started indicating to turn down my road, he was 100yares away, slowing down with a que of traffic behind, so I nipped out, but he was not turning and admitted to having left the indicator on from his previous turn.

He admitted liability and said it was his fault, but my insurace company have said that it will all be pinned on me!!

On the + side. Its been 2 hours since impact and I already have the car collected and swopped for a cuotocy car that I keep till I get mine back! Good service I feel. (norwich union)


I think that twinned with the Noble bump, my insurance may be slightly offensive next feb! (bye bye Noble??)

Never nice to have an accident, but at least there is no serious damage. Also lucky it was in the workhorse.

My driving instructor always told me to wait for any car (indicating or not) to actually make the turn before pulling out. Many friends have abused me for sticking to that rule, but this is a perfect example of why it makes sense.

By the way, I am not trying to claim to be a better driver!

Fancy a job at Noble? Simon mentioned that they're gonna have to smack an M14 into a wall (well, its a bit more scientific) to get EU approvals.

Do they have a lesson on "The art of Assumption" and "not pulling out till they start to turn" !!


This is another fine example in my life that "Assumption is the mother of all f***ups!!!"

Oh well, it will all be forgotten soon. until the renewal arrives!!

Please don't do that!!! Can we make a fake M14 on an MR2 chassis and give that one to the testers then I can have the real M14 Thats a good idea isn't it!?

2/3 1/3 in the other drivers favour.

Wadsworth v Gillespie.

Were there any witnesses? If the old boy admits to leaving his indicator on you should be able to get 1/3 of your claim(?) paid.

Does this help?

At least you only forfeit 2/3's of your policy excess.

Just had a quick google:

In Wadsworth –v- Gillespie (1978) a motorcyclist had completed a left hand turn and had failed to cancel their left hand indicator after completing the manoeuvre.

A motorist was awaiting to emerge from a side road and having seen the motorcyclist assumed that they intended to turn left into the road from where the motorist was waiting to emerge.

The motorist pulled out, the motorcyclist did not turn left but was intending to proceed straight on and a collision occurred. In that case it was held that the motorcyclist had to accept some proportion of liability on the basis that they had given a misleading turn signal to the motorist and liability was apportioned by the Court two-thirds against the motorcyclist.

It does beggar belief that in this day and age manufacturors are still producing cars in which it is possible to leave the indicator on. Why don't indicator units have a time-span, say of 20 secs or so?

Given the damage I would assume you pullled out right in front of him rather than while he was a hundred yards away? In which case it's unfortunate, but seems to me that you are clearly in the wrong. Time to develop some paranoia behind the wheel, they really are out to get you.

As the old saying goes " never assume, it makes an ASS out of U and ME"
That said though I'm sure we've all nipped out in front of people indicating at some time during our driving career so there but for the grace of God!! I assume (there I've done it too) that there were no injuries, at least the cars can be unbent.

They do! Hired a car over 10 years ago in the US and it had just this safety feature!

This is the only safe way to drive. This attitude usualy aquired after your first "the car driver who didn't see me on my motorbike" type accident.

Having ridden motorbikes for a good few years I do think you learn to look at different things in different ways. I do 30k miles a year and have never had a fault accident. Silly of me not to look back and check that he had actually turned in before coming out, but in the situation (that I have every morning) if you do that then you miss your gap and have to wait another 15 minutes before some kind soul lets you out!

The traffic was churning along at sub 20 mph so yes it was a little too late for him to avoid me, but the car seemed to be made of cheese! Look really bad considering it was such a low speed bump!

Oh, well, these things happen. Maybe tomorrow I will feel less sheepish!!

Thanks for the case study heads up. Could come in handy in the likely legal battle I intend to start.

Do you mean 2/3 in my favour or his. (2/3rds being better right?)
