The warranty company have now sent a letter saying that it broke because the bearing had micro pitting and so shock loaded the gears. Now if this was the case then surely all of the gears would be knackered and not just 5th?

Why does it matter why it broke, or do gearboxes come under consumables? which company was it?
Warranty company was warrantywise.
Gearboxman rebuilt it for just under £900 and then £1900+vat labour from the dealer for the removal/refitting.
The guys at gearboxman told me the 'independant' inspector was only interested in blaming wear and tear on the bearing and nothing else.
I've been speaking to Noble as well and the technical people say that from the images etc then this is what happens with the weak 5th gear but it wouldn't have been caused by a worn bearing.

Makes a bit of a joke having a warranty if something is so obviously fecked by an 'event' rather than wear and tear.
My experience of these things is that you are better off banking the warranty money for the inevitable rainy day.
Unfortunately claim repudiation like this gives the insurance industry a bad name.
I work as a Senior Manager in the insurance Industry and I wont put my business with certain companies simply because they operate in a manner such as this.

If I knew the warranty company wasn't going to cough up then I certainly wouldn't have gone to the dealer.....bit late now though as I get the car back Monday now it's all been put back together!James
What actually happened was I changed into 5th....it started to make a funny noise....changed to 6th..no noise...back to 5th...noise again....slowed into 4th..no noise.....pulled over and put it into neutral...noise was there all the time then until I put the clutch in so got the car recovered.
I just found it strange that if it was the bearing then it should have done some damage to other gears other than 5th whereas if it was a weak 5th gear (as Noble technical have told me after sending the pics) then nothing else would be affected?
I think it's definitely worth me arguing my case with the warranty company.
