DVLA won't let me tax my Locoblade

I bought my Locoblade earlier this year, understanding that as it was registered in 2008 I wouldn't need an MOT for another 2 years. But I've just gone to tax it and it's saying I need an MOT. I rang up the DVLA and they say it does needs an MOT and should've have an MOT when it was built, along with the SVA. Does anyone know any better? The car is on a Q plate by the way, I don't know if that makes a difference?

As with all things Kit Car, it depends which DVLA centre you talk to. The rules say that a new build car, regardless of which reg it ends up with, should not need an MOT for 3 years, just as any other new build car. However, many centres treat a non-new plate reg as any other car, ie MOT every year. You do not require an MOT to register a car, although many DVLA offices seem to demand one.
Try taxing online, know of several cases just like yours that have been resolved by taxing online.
eta if the car was sva'd and 1st registered in 2008 then it does not need a MOT till 2011 regardless of registration given, that merely shows whether enough donor parts where used to get age related, enough new parts where used to get new reg or not enough of either resulting in a Q plate, some post offices/dvla staff understand this some don't, the online system does hence my reply above.

A "Q" plate is issued when the true age of a vehicle cannot be determined.
1973 Registered cars would either be L or M reg.......
Talk to DVLA Swansea. An MOT is not required immediately after the registration even though some local offices seem to think so. I have a letter from Swansea telling a local office they are a bunch of c0cktards somewhere, I think it might be pinned in the SVA section of the rhocar forums.
As for whether a kit chould require an MOT after 1 or 3 years it was my understanding that a new build should not require an MOT for 3 years but kit registered on an age related plate or Q plate does require one after 1 year. Having said that the Reading office put my age related kit down as not needing an MOT for 3 years and they are usually pretty good at getting it right as Paul Jepson (an ex DVLA guy) puts all the paperwork he does for people through Reading and he knows what he is talking about.

ok...what is the problem...a new built kit, first registered in 2008 will not have any problems to pass a further mot, won´t it?
before i would argue and start discussing with the authorities i would invest a few pound and drive it to the mot station. finally the easiest way, isnt it?

As has been said already, try taxing it online. I was told when mine was inspected by the DVLA, after the SVA but before registration was completed, that I wouldn't need to get an MOT for 3 years as it was effectively a new car, as I had expected. That said I wouldn't be at all surprised if an inspector for another DVLA office had said that I need one after the first year.
I suspect you're stuck with what the online system tells you when you try to tax it on there. If it says you need a valid MOT then I think you might be snookered.

The law has changed very recently, so that a Q car does NOT need an MOT for three years. When my tax reminder fell through the letterbox it did read MOT required, to be honest i wasnt bothered as the price of an MOT is probably the cheapest engineering saftey test you could buy but in my head also was the fact i didnt want to give the gov more of my hard earned if i didnt have to.
I took my V5 to my local PO for tax and after the nice person behind the counter read the V5 stating the car was first registered in 2004 they accepted the cash and passed over the disc.
As said earlier you can contact swansea and a form is available.

I have been through this one with mine, which is on an age related plate. On SVA it was taxed seemingly with no MOT, when the tax expired 6 months later I could not re-tax it. After speaking to various people in various DVLA offices I decided that non of them could actually agree but that it probably should have had an MOT (no idea how it was ever taxed without one) and that even if technically I did not need one then well frankly the £40 test was by far the simplest, quickest way out of the situation. Thankfully it sailed though.

SVA'd my old cobra in 2004 on a 1982 age related plate, the DVLA (Chelmsford)insisted on an MOT cert to register it (I'm pretty sure it didn't really need one for registration but wasn't worth arguing with them as I did an MOT on it as a sort of pre SVA thingy to make sure the headlights and brakes were ok). one year later went to the post office to get the new tax disc gave the bloke the new MOT cert and he handed it straight back to me and said I didn't need one for 3 years. this seems to be the norm for most of the guys with cobras whether new reg or age related it doesn't need an MOT for the first 3 yr, dont know if Q plates are differant though.
