It'd be odd to appeal against the result of something they won I agree.Group Lotus were never going to lose the rights to use "Lotus". So the only thing they could win was blocking the use of Team Lotus by another. And that didn't happen.
The question in my mind is why appeal. The evidence will not change. This is old ground not something where a new development might happen.

I think the bit that Group Lotus could have lost was to use 'Lotus' in F1 and the black and gold, as the counter-argument was it 'belonged' to Team Lotus, since Group Lotus never raced in F1 before... or something like that! Group Lotus were never going to lose the rights to use "Lotus". So the only thing they could win was blocking the use of Team Lotus by another. And that didn't happen.

A I've said before you need to understand Malaysian business, to fully understand why this happend, the above quote is right on the money, I understand the Malaysian cabanit meet late last week to discuss pulling government money out of F1 and how they can terminate the ongoing agreement to fund the sepang race.
As to the argument that Team Lotus damage the brand by being at the back of the grid, the damage they do is not half as much as seeing protons driving around with handling by lotus badges on them. The new R3 Proton satria that proton had on show at Sepang last week was awfull.
