Hmmm, after Monza, could that be saying something? Also with Lewis 20 points up on Kimi and McLaren 14 points up on Ferrari, time for them to get a sufficient lead cut back? I'm sure the conspiracy theories will abound

Could McLaren appeal against a decision of the Court of Appeal? One wonders what might be brought up by ferrari who are very reluctant to give information about their case before any hearing. The main reason so many people doubt the honesty and integrity of so many official bodies is that so many official bodies are less than open in their procedures and decision-making processes.

I feel certain that the Court of Appeal is above bowing to influence, pressure and bribery, even if some of the richest companies, persons and pressure groups have a vested interest in the outcome.

However, one wonders how a court could overturn a unanimous decision of a lower court. They can criticise procedures and methods, but not such an overwhelming judgement. The only hope for ferrari would be a smoking gun. Anything less would be a travesty.

The McLaren letter is a major obstacle to a successful appeal attempt. It states quite clearly that both McLaren and ferrari had rogue employees who were working for their own ends. Whethe this is true or not is not the point. The letter gives times, dates, names, procedures and further, states many, many times that all the information on the dossier was retained by the employee at his home. The only way to render any overturning of the earlier decision acceptable is to prove McLaren had knowledge of the document. One wonders why, if ferrari have such evidence, they didn't use it earlier. Perhaps to Catch McLaren in a lie. Ah, but that would be a conspiracy and they, of course, don't exist.

What's really damaging to Ron is that sponsors dont really wanna be associated with cheating lies industrial theft photocopying of industrial secrets and general sleaze.
Should imagine Santander are scratching their heads right now and thats why Ron wants the bodies burried. The scandal is causing quite a stink in many boardrooms.

Im off to Monza to fly the red and yellow flag. Expect the atmosphere to be electric with all this in the background.

. . . I again ask you to look at the real facts, which are that Ferrari fully participated in the hearing before the Council.

First, Ferrari submitted a lengthy, albeit grossly misleading, memorandum dated 16th July 2007 along with supporting documents which together totalled 118 pages.

Ferrari did not send McLaren the memorandum. The memorandum was circulated to the Council on the 20 July. McLaren did not see it until two days before the hearing and it was only then that we were able to correct its grossly inaccurate contents.

In the meantime, the misleading Ferrari memorandum or sections of it appear to have been leaked to the Italian press as much of the Italian press reports echo elements of that memorandum.

In addition to this Ferrari, who were represented by lawyers, were given several opportunities by the FIA President to ask questions and make submissions throughout the hearing. Mr Todt also gave evidence.

It was clear that the FIA President afforded Ferrari every opportunity to be heard in order to ensure that all relevant matters were heard by the WMSC. Indeed, at the very end of the proceeding, Ferrari intervened with a request to make further closing comments. Ferrari's request was permitted and their lawyer proceeded to make further detailed closing comments at some length.

I therefore simply do not understand what basis there is for Ferrari's claim that it was denied an opportunity to put its case. It put its case both in writing and orally.

I gather it was as stupidly simple as Todd not being able to comment during the actual hearing. Todd must have been incandessent an being told to button it.

What seems commen sense to us mortals often passes over the heads of those with power.
