Asked yesterday for info on if i could make a claim or not . After no real info but more useless info about my spelling .The pot hole actually ripped the tyre off the wheel . I have reported it to local council and they have put a claim through for me .

same happened to me, the council blamed the water company, the water company blamed electric company, they blamed cable company etc, etc

make sure you have photo of pothole as they filled the one i went down within the hour, they are all a bunch of bds

You would think people would be happy they acted so promptly when notified of a problem smile. Lazy useless council incompetents.

Hit a massive pot-hole in my wifes Smart, caused £700 worth of damage, Tell local highways department, then get back ASAP at take tons of pics, as they,ll fill them in hours and claim there was no hole. filed claim with Oxfordhigways and payed for repairs out of my own pocket ,to save NCB, Pestered them weekly, got paid back in full, less £20 for wear and tear on my tyres (cheecky f**kers)

tell them its black and white, there road damaged your property, end of story!

I think in gerneal this is becoming more and more of an issue especially as Councils are cutting back on repairs. In Milton Keynes some roads have had significant pot holes for over 18 months now with no sign of repair whatsoever what makes it even worse is they have turned off the majority of the street lighting so now unless you know where the pot holes are you will get caught out

Someone at work had his alloy buckled on his fiesta last year in a pot hole and less than 2 weeks later he damaged another one on a different pot hole. His cousin who works for a soliciter advised that he probably wouldn't get anything and that if the council already knew aboutt the whole then they don't have to pay out. Not sure the truth in that but he got nothing back and had to buy 2 alloys from ford.
He didn't put much of a fight up I don't think, I know I would. No way I would let council get away with that

I have claimed quite substantial sums over the years, via the Small Claims Court.
That's should be what this and the laws are there for and one of the reasons I pay so much in tax.

10 years ago, they would just send a cheque after writing a letter and maybe filling a form, these days it always seems to either go to court or be settled the day before.

They seem to spend more money on solicitors than they do on the repairs.
You can use money claim online website run by HMCS.

They always try and use the Statutory Defence of either not knowing about the defect or knowing about it and fixing it as soon as reasonably practical. They seem to treat this as a get out of jail card but it is not.
You have to show by way of photographic evidence and their own history of repairs on that road that...

The defect took time to develop.
The overall condition of the road is poor.
Their inspection and repair regime was insufficient.
You have mitigated your losses (such as don't claim the full cost of worn tyres etc...)
The defect was not unforeseeable, such as a collapsed culvert that gave no forewarning.
