Hello,

Need some advice regarding problems with my warranty. Bought my car from a dealer last year with a 1 yr warranty. Recently had a fault with the car which should be covered by the warranty(ECU) and when my garage informed the warranty co. they had no record of the warranty. When I got the car I signed the papers and have a copy. Problem is now I had to pay the garage to complete the work and have been contacting the dealer on numerous occasions but keep getting various excuses that it will be sorted out. I have kept civil over the whole matter but getting annoyed now as it has dragged on for a while. Need some advice regarding where to go from here and where my legal standing is.

Is the warranty a Porsche warranty or 3rd party?

I cant give any legal advice but might be able to offer an insight.
If you signed a warranty you will have a policy number, and likely that the warranty company would have contacted you about their services during the first month or so.
What you actually buy with a used warranty is a mechanical breakdown insurance.....an insurance policy.
You are entitled to that whether its included in the sale price or sold in addition to the price (your invoice will reveal).
Presumeably youve contacted the warranty company and they have no record of your policy.
What may have occured is that the dealer forgot or neglected to process(and pay for)the warranty and now its too late.
The likely legal position is that the dealer is responsible and needs to meet the cost of the repair which should have been covered under the terms of the sale (and warranty). I think I might put in writing, with a quote, and offer that they fix the car within 14 days, if not you may have to pursue through small claims.
Sadly if the dealer neglected to actually buy the warranty for your car , for whatever reason, it cant be reversed.
Unless the dealer can prove otherwise he will have 'saved' the warranty cost which could help pay for your repair.

Have had a similar problem recently and I took legal advice.
You have a contract with the dealer for the sale of the car and whatever warranty was agreed at the time of the sale. Your contract is with the dealer not the warranty company. If the dealer has not provided that level of cover then your redress is with him.
You should give him the opportunity to sort out the contract with the warranty company and then if that does not happen within a reasonable time then it is up to you to sue the dealer.
I am going through a similar process at the moment so if you want to mail me off list I can go through the process with you.
