Discussion
My dear lady wife was involved in a small coming together in a car park yesterday, mercifully not in the 993.
Difficult to say if any real blame can be apportioned. My wife was backing and the guy who hit her has driven past then decided to reverse back at some speed on the wrong side of the road, swiping the back of my wife’s car as she backed out v- she only got about a foot out of the space.
Virtually no damage to our car – but his has are designed drivers side.
I want to avoid going ‘knock for knock’ as we would rather have the damage sorted out privately. Is it reasonable for me to insist we each claim of our own policies?
Sorry to hear of the accident. It sounds to me like he was watching your wife reverse out and decided to drive into her space! Has he intimated any claim against you?
You obviously can't "insist" that his insurers deal with his own damage and do not claim against you as ultimately it is the insurers decision as to how they proceed to settlement. What you can do is notify your insurers that an accident has happened and confirm that it was NOT your wife's fault, and that you are not claiming for your damage as it falls within your policy excess. Basically put up a brick wall, but remember your insurers may decide to settle his claim to avoid lengthy correspondence/possible litigation. This may all hinge on the amount of damage and whether it is commercially viable for his insurers to pursue it against yours/you for that matter.
Hope this helps.
