Would appreciate thoughts on this saga folks....

Recently had an OPC supplied 993 suspension kit (dampers and springs) fitted to my car by an independent specialist. Also asked for a geo to be done and look at a 'wobble' which happened at about 60 mph. Paid them about £800 excluding the suspension.

Drove home and all seemed OK but then a clunk emerged from front nearside. Took it back to them, they agreed there was a noise and they suggested I run for a couple of hundred miles to see if it got worse. It did, so I took it back. They had it for 2 days but couldn't figure out the problem. Ultimately they were '95% certain' that the damper itself was faulty.

So, off to OPC Guildford who booked the car in for 2 days. Diagnosis...top mount not tightened up properly. That was about 8 weeks ago and the problem hasn't come back.

I've spoke to the independant and faxed them the invoice from the OPC for the work. I also gave them the name of the OPC technician so they could speak to him. They didn't seem to accept that something so obvious could have been the problem. They've hinted that they would give me a credit to the value of the OPC invoice but I hinted politely that I don't want them anywhere near my car.

Phoned twice since then but no one returns my calls and no formal offer of compensation has been received.

They didn't actually take the wheel wobble out either and they also managed to push in one side of my stereo head unit (which they denied) and by some coincidence the driver side front speaker has intermittent problems.

In short, big thumbs down for the indi. They are expensive, failed to fit suspension properly (and they boast about setting up GT3s etc for Porsche Motorsport), failed to cure balancing problem, did something to my stereo and now won't return my calls.

We're not talking about lots of money here but their lack of customer focus has got my goat.

I'm thinking of writing to them to claim the OPC costs plus all the travelling I had to do plus asking them to deduct an amount from their bill because the balancing hadn't been done. All mixed in with a hint that I'm prepared to go to the small claims court.

However, I'm not a lawyer, just furious.

Wise words needed....none refused.

Go round and see them. If they refuse to see you and talk it over like adults then write them a letter making clear what you actually want. I suggest you have a very good claim for having the OPC bill reimbursed as you have a diagnosis and an inoice for correcting the work that they were paid to carry out. Give them seven days to reimburse the bill if they don't comply then take them to the small claims court. The other bits and pieces like radio and speakers will be more difficult to prove.

Good luck

Since the claim is sub-£5,000, it will inevitably be allocated to the small claims track - this means that, in general, no legal costs will be recoverable by either side, win or lose. This means that they will have to deal with the claim themselves unless they want to end up out of pocket using solicitors.

Is the indy in question a limited company? If it is, there will not be an automatic transfer to its home county court so, depending on where you are, this again could cause hassle for them if they have to travel to attend hearings.

The way the court will approach it is to consider whether the services provided was of satisfactory quality or not. With evidence to show that the OPC was able to diagnose the fault and resolve it quite quickly, and there having been no recurrence, there's a pretty strong circumstantial case to suggest that the indy missed something reasonably obvious, and that this amounts to unsatisfactory service.

The indy will have to explain why it does not think that the OPC diagnosis was the answer to the problem it was seeking to deal with. Proving a negative can be quite difficult, especially if all they are able to say is that "We wouldn't have missed something that obvious".

The slight fly in the ointment is that the court may want expert evidence to support your claim. It may be worth seeing whether you can get a short statement from the technician at the OPC who dealt with the problem for you.

It's also worth checking your home contents policy to see whether it includes legal expenses insurance cover - if it does, notify the claim and get them to appoint solicitors to deal with it on your behalf.

HTH.

If they have hinted at a credit note then they are some way to accepting blame imho.

Ask them to confirm in writing and then see a Solicitor. Do you have Legal Assist on your car policy ??

You should write to them by recorded delivery setting out what you want and stating that unless they meet your requirements within 7 days you will take the matter to court without recourse to them.

If they don't respond, go to www.moneyclaim.gov.uk and fill out the form, pay the £30 - £120 (depending on how much you're claiming, this fee gets added to the claim so you'll get it back) and that's it.

There are 3 potential outcomes from there (in order of likelyhood):
1) they pay up
2) they do nothing, you get judgment & they have to pay up
3) they go to court to fight it - if they ask one, I doubt any lwayer would recommend them to do this, unless said lawyer was going to get paid to represent them (not that I'm cynical about lawyers recommending things that earn them money )

Even if you have to go to court it seems you have a very strong case so I wouldn't worry too much. Besides your time, the only risk is the court fee even if it all goes wrong and you loose. Seems unlikely that you will.

Im surprised that you are surprised..i wouldnt trust an indie with pumping up my tyres, they are as bad if not worse than the OPC's and you have little comeback by comparison as you have just discovered. My main dealer may be a bit economical with the truth and try the occassional rip-off but they are under considerable pressure not to get caught..who monitors 'indies' behaviour?

I have different experience. I trust my indie with my 993tt for anything I can't sort out myself. They always run thru the costs before any work and explain them to me. They often advise me not to do certain things until they really need doing but leave the choice up to me. For example, I asked if it would be a good idea to fit the RS roll bars and was advised thatif I used the car mostly on the road not to bother.

Speaking about service here - not sales.

I think some of the specialists in the Porsche world are amongst the most honest and enthusiastic in the business. When it comes to "buying in" service and repair work I imagine I outspend anyone on this site by a factor getting on for 100 so do have a little experience and the subject is something very close to my heart.

There are some villains and people operating on a wing and a prayer but there are far more people who take immense pride because it is their own business, their name above the door. There is no "Mr Porsche centre Bognor Regis" or "Mr Porsche Centre Shorpe", indeed Porsche themselves are a series of customer support dialogue operatives with varying degrees of ability and knowledge, none of them accountable. When things go wrong the moral high ground is always taken and no one holds their hands up, you`ll never get to meet the bloke who works on your car (although there is some random dude`s name on the invoice).

With an independent there is a person you can ultimately speak to. In the O/P`s case the person`s name is well known and whilst not a company we deal with I am sure you will find it quite possible to speak to Mr R. Try getting Andy Goss on the phone ! Were the tables reversed I can not believe that the OPC would refund an invoice for corrective work. They would, as usual, take the moral and technical high ground.

We do use the dealer network from time to time and have had problems, in fairness we have also had work done well. Similarly we have had problems with work carried out by the independents but in every case it`s been very easy to pick up the phone, speak to the big cheese and get the problem resolved.

On a final not I`ve lost count of the number of times I`ve heard of a specialist going the extra mile, often at no cost. I`m not sure the corporate weight of the OPC network is quite so flexible.

Henry

edited to say I never realised you couldn`t type Shorpe (a town quite close to Gainsborough) !

I saw the original post including the name of the indy concerned and have to admit to being extremely surprised. Without naming them, they have probably one the best reputations around bar none especially when it comes to suspension/geometry work and have prepared numerous cars for other PH members - never heard a bad thing said against them.

Personally know of three people who've used them and all have been very happy.

Not sure we're hearing the full picture here and glad the post was edited - Just my two pence worth.

I would disagree KayC...I have used Autostrasse for the 5 years I've had my car and not had one single problem. They came highly recommended by a colleague and I would pass on that recommendation to anyone. Even though I have moved to a different part of the world I have continued using them and to be honest I wouldn't dream of going anywhere else. Pity they don't do geometry set-ups!

Thats a good point actually and one that has already crossed my mind,it has been serviced by the same OPC since new in 1997 up until may 05 when it went to an independent that i dont care for at all...i think the original OPC will get the shout in the end as they know the car..
