I'm interested how this works and I was wondering if Henry has an idea as he's been around a bit and knows stuff.
In my hypothetical situation (no naming & shaming on PH!), we'll assume there was a car dealer in London specialising in very nice Italian sports cars and there has been a degree of bad press implying that said dealer has had cars on Sale-Or-Return and once sold has not paid (or paid very late) the owner. In addition some rumours have now appeared on Wikipedia and suggest that he's in debt to the tune of hundreds of thousands to previous owners and to the taxman. Clearly, he's gone bust and disappeared.
Now, if this imaginary proprietor popped up again running a similar car salesroom showing what looks like a similar stock, one may ask how.
So how? Who gives their exceedingly expensive (150k+) car to a showroom that pops up in the middle of nowwhere run by a guy with a reputation, who is in considerable debt? What are these owners like? Is the world really full of stupid people or clever conmen (or both?!)
I just can't possibly fathom how this would be possible....

I would imagine that if one limited company is in receivership/administration/liquidation that doesn't actually prevent a director/owner/part-owner of it from being employed by another company (perhaps owned by a family member) to do the same job he used to at the last place. Happens in lots of businesses, not just cars.
Likewise, if owners of cars that were on SOR at the 1st company in the example above, choose to place them on SOR with the second company, that is their prerogative (however foolish you might think them to be).
Just to be absolutely clear - I have absolutely no idea who you are talking about here. I'm sure others will be along who have an idea who you mean, but I don't - my response is purely conjecture based on a hypothetical situation.

It's not fair and it happens all the time. I got shafted for a non trivial sum the other year and the guy starts up down the road the very next day. Nothing can be done within the law.

Chap phones up a few dealers to be told his car is worth £30k. Another dealer says he can return £34k. He has a load of other flash cars around him to give our man a bit of comfort, (obviously S.O.R as well), and there you go. Possibly even has a nice rented showroom and double page adverts in a couple of the trade rags. The reality is that everyone has to make money & contrary to popular belief the margins are usually not as high as some would have you believe.
When you`ve been burned by a bad deal as in the case of a dealer that went bust with your car you tend to feel a bit silly and keep it to yourself. I have my suspicions about a few dealers out there but politeness & naming & shaming rules prohibit my making comments.
Incidentally as a dealer I`m actually all for naming & shaming. The real villains never get talked about because no one has anything good to say, and if someone does post a comment or question people`s hands are tied in responding negatively.

There are ways of saying things that will get concerns across and still be keeping within the sites no naming and shaming rules. eg.
"I'd prefer to deal with another company"
"had dealings with them, will be going elsewhere in future, email me if you want details"
"there are better companies to deal with"

The problem is that if it was a problem someone had had with my company I`d want the cause out in the open so that:
a. Readers can make their own mind up as to exactly how serious or genuine the problem really was.
b. I could deal with it if was a fault I was un-aware of or a re-occuring issue.
As it is the viewer can`t descriminate between someone who has never had any dealings with a company but just doesn`t like them, someone who is unreasonable in their expectations and someone who has been genuinely shafted.
I think you`ve almost got more potential liable issues with incinuated or implied critisism which turns out to be unfounded.

I am a car dealer and a Porsche owner. I have just bought a new showroom and forecourt(i have bought the freehold) and split my stock between two branches.
I cannot beleave the post I am now getting addressed to the previous guy who rented this place.
I dont think he ever paid a VAT bill or any warranty bills.
However its so nice to see that he now has a fancy new name and webb site with all the same cars lots on SOR and now working from home may not be his I guess. Its not fair to us respectable dealers and yes I agree with Henry it would be nice to be able to Name and Shame! Looking for a second car in Hampshire? I know where not to shop!

You have to realise Pikey that not everyone has access to t'internet, and even those that do may not spend their days reading motoring forums or Wikis. 
Sadly, to those who have no means of checking out his history (nor feel the need to do so) he probably appears to be a fine upstanding member of the used car trade. Member being the operative word.
