Black Box used as evidence in crash

I know "black boxes" in cars have been discussed here before but I came across this article this morning and thought it was interesting.

It's a US case where the evidence from one of these things was used to back up a case for manslaughter. In this case it certainly wasn't the only evidence but it opens up some areas for the future. For example, if you're speeding and someone pulls out in front of you and you have an accident then could the insurance company invalidate your insurance as you were breaking the law at the time? Speeding is probably a bad example but you get what I mean (I hope!).
How many European cars have these things already I wonder and have they been used as evidence in any cases over here yet?
