Clarkson caught using mobile phone

According to todays Metro newspaper Jeremy Clarkson has been photographed allegedly using his mobile phone whilst driving, the driver who is named apparently caught him whilst on the M40 and Thames Valley police are now investigating!!

I'd like to know how the driver took the photo, no doubt he did it with his mobile phone. Is he being investigated for driving without due care etc??
