So theoretically?

a) One of my tyres is under the legal limit. I get stopped and fined/pointed/banned etc, and rightly so.

b) My vehicle is mint and I hit a massive, known, documented pothole. I smash the tyre, wheel and suspension, go into a flat spin and take out a couple of pedestrians. Does the council leader who has willingly accepted my taxes get punished? I doubt so. That's what I love about this country at the moment.

In my part of kent: likelihood of me running ilegal tyres, zero. Likelihood of me hitting a pothole next week, 100 per cent.

Quick visual inspection when dropping the wheel off says no, don't think so, but I was quite preoccupied with wishing vast swathes of general badness in the council's direction in a spanner handed, muttering, psychotic kinda way.

Cheeky goit, them 'cheap' dampers are race-specced shocks that iirc were something north of 2k when new. 1 seasons use and they were refurbed and sold to me. I'll see how much this one is to repair (if actually possible) before I change the other side as well. The council will be hearing my dulcet tones come Monday....

Out of interest where was the pothole, my Boss seriously damaged her Aston on Potholes in Guildford and she is still pursuing the claim.

Go and take some pictures of the hole, including a depth measurement with a ruler before they fill it in.....

it happeed to me years ago, hit a subsided part of road and cracked a spoke on an alloy and blew a tyre. i took a load of photos of the damage but none of the pothole. wrote a really long letter explaining i needed a new wheel, new tyre, tracking etc and provided the prices and gagrages number etc and they later sent me a cheque for the full amount. it as a different authority but i have every faith they will pay out for a new shock for you.

highways deaprtment will probably have had loads of complaints about it.

Right, off to photo/measure the pot-hole this avo and get the claim in to Merton council. However, having just spoke to Gaz, they reckon they can have it repaired in 2-3 days and it'll be around the 50 quid mark, so the hassle of claiming may outweigh the cost of repair. hmmmmm......

The crucial thing is whether they have stuck to their own inspection regime for the stretch of road. If they have said they will check it every 6 months or every 5 years, that's all they need to do. This happened to me, and my local council said they had inspected it within the timeframe and knocked the claim back. So I paid for it out of my own pocket (£1000 on a brand new merc) and now also have to tell insurers that i had a claim even though it was withdrawn.

Trouble is now the councils are getting lots of claims so do their best to refute them. My son smashed an alloy wheel on his focus. They shut a road and sent traffic down a back road which was in very poor condition. He dropped a wheel into a 6" deep pothole at the side of the road in the dark and it shattered the alloy and he was stuck. I had to go out with tools/jackes etc and rescue him.

Wilts council argued long and hard to avoid paying, but after about a year paid up. They filled in the hole the next day after the accident after we reported it though!

Persue the barstewards. I burst two tyres, bent an alloy and destroyed a wheel bearing on a back road in east Sussex. It took a year to get the claim paid. I think most people just give up.
Take a picture of the hole, length, depth, location etc with ruler in shot and do a 'net search on the local authority website to see if anybody else has had the same misfortune. If it ends up in court it's very useful. And don't take any stick about producing your insurance certificate, no road traffic accident took place so producing is irrelevant. Hope you get somwhere quicker than I did.
