makes me shudder to see stuff like this, on the bike you would be in hospital at best right now....i wont mention 'at worst'

Be careful brummie. The insurance company will try to make that your fault. Try and get something off him in writing admitting fault.
If he was stationary and opened his door, then its regarded as the your fault that you drove past without giving enough room.
One of the biggest payouts I've seen was an eight year old girl who opened a door into flowing ttraffice and got dragged along by a car that took the door off. It was regarded as 100% the fault of the passing car who didn't leave enough room.

If the door was already open, thats the get out. I was following a car and once that one passed he opened in front of me, not even enough time to brake. It was that quick. He has been good enough to own up. I've had this car 1 week to the day!
Agreed about looking out for dangers, on the bike prolly would have been further out, but in the car you dont have so much space and you cant account for everyones lack of awareness, its impossible you cant see in to the future. Well i cant anyway.

His insurance have agreed it was the car door openers fault, he admitted he didnt see me, very honest of the guy and i am at least thankful for that. I have been told its like pulling out on someone, you should look first. If not i am going to rack a load of £50 cars up and i can have a dozen doors off before tucking in to my cheese and onion sandwiches!

Stuggling with that, to be honest, as the insurance companies decision in the OPs case confirms.If anything I would have thought that as the girl was only 8 it would be the driver of the car she was in who was responsible for not supervising her getting out of the car.
