I ask as I have found so much conflicting answers on the web

like this below

"My wife works for an insurance company "hic", Just mentioned this to her and she said They would not even consider taking into consideration the fact you where parked in a buss stop, they wouldn't get involved in any thing like this even if the other party is at fault because it would not effect weather or not they would have to pay out or not.

The only thing the buss driver could do is report you to the police and with out any other evidence than his word against yours they wont do **** all so don't worry about it. "

Also this one

"As others have said, the bus driver was trying to scare you. Claim against them.

My brother in law parked his car stupidly in a bus stop, a bus hit it and he claimed against them. There was talk of a £100 fine for being parked there. That wasnt a problem as the bus driver hit the car so hard it did £800 worth of damage. "

Any legals out there who know the score for FACT ?

Last year I was parked on a corner which had double yellow lines. Another vehicle scraped past my rear nearside bumper damaging it and damaging the entire side of her car. Details were exchanged and my car repaired. Nine months later, they other party chnaged the story and said i had reversed into her, even though i was sitting in the car with the engine off.

It then went to County court and one of the points the opposing side argued was that I was parked illegally on double yellow lines, tehrefore I was also at fault etc.

I won the case that day. It doesn't matter if you are parked illegally or not if involved in an accident. Only thing that can happen is you could get a parking ticket. The onus is on a driver to take reasonable car when driving.

Hope that answers your question. biggrin

You will be insured - irrespective of whether you were parked legally or not. The issue is negligence, and with the exception of a few specific legal scenario's, anybody hitting a stationary vehicle is going to have a hard time convinving a court they weren`t the negligent party.

Feck, that is one expensive bumper! I bet it costs the same to make as a bumper on a mazda MX5 and I bet Mazda only charge £150. Serves you right for having and Audi.....sorry Lambo! Only joking because I am jealous

I was parked not in the car engine off etc... and the bus who I pulled behind who had his hazards on out of service decided to reverse straight into my car..lol

The road was closed as there was a fatality ahead so I pulled in behind to find out how to get where I needed from the police came back and the driver said your car !!!! yep OUCH !!!! He must have thought I was mad as I did laugh ...

When I was 18 and driving a pop wagon I stopped at the side of the road to look at my map, realised I'd overshot by 50 metres so thought I'd just back up. In the meantime, with the speed of greased lightening someone had parked a mini right behind me. First thing I heard was the scraping and glass breaking.

After the hour long rollicking from the boss I learnt an important lesson. Don't reverse a big thing on the public road without someone to see you back.

I wonder how long the bus driver's rollicking lasted????

SirMark,

There is a prime offertunity to make the system work to your advantage. Ask the insurance company to make a payment in leiu of repairs, essentially iff the assessor deems the parts to be new bumper, at 10k, and allows a set amount for removal, refitment, and painting labour, also the cost of materials, you could be looking at a very nice cheque amount, then I can assure you you could get it done for half the price, maybe less.

I have a fair amount of experience in areas that could help you if you had any questions, i'd be happy to awnser them, shoot me a PM if there is anything.
