I can understand the volume - I have the Wortec headers/cat/catback on "quiet" (silencers in) and it's fairly thunderous under load. I don't think it would be bearable on "loud".Tell him to show you in the MOT manual what the noise levels are......and he wont be able to.
They dont exist.
It may however say excessive noise or defective, but it would need to be pretty extreme to warrant a fail IMO.
Its usually only wanky cops that get on their high horse over such things....we have a few of them over here.

I have 2004 CV8 with headers, cats and straight through cat back... NO silencers.
Rated at about 127.4 db last time I checked. Very loud and can't fail an MOT.

b. assess subjectively the effectiveness of the silencer in reducing exhaust noise to a level considered to be average for the vehicle b. a silencer in such a condition, or of such a type, that the noise emitted from the vehicle is clearly unreasonably above the level expected from a similar vehicle with a silencer in average condition
so its a subjective failure, you could find a friendlier tester but as vosa is all online now if a failure is reported and logged at one place you will find it hard to find anywhere else to accept liability for the pass.
