To all making unsubstantiated comments via this and other internet based forums AMOC etc
Just to summarise on the legal position as defamation isn’t the case here.. I would basically litigate on the grounds that false posts were deliberately being made on various websites designed to detract from the cars re sale value, by making false claims in relation to the suitability of the repair undertaken by me on this car.. These claims creating financial loses that can be directly attributed to the actions of third parties for example you by making these posts.
The state of the car pre-accident has no legal bearing whatsoever as the position of this case would be set out on the legal categorisation of the damage, this being CAT D, rather than Astons accident report or indeed yours or any other post accident pre repair photos, both the latter documents have no legal bearing whatsoever.
As a part of this action I would produce a VOSA certificate of road worthiness in order in order to demonstrate that the vehicle is repaired and suitable for the sale as a motor vehicle, to be used on the road or otherwise, and that throughout the sale process it has been openly declared as a CAT D repaired. On this basis I would pursue damages and costs against those making the posts.
I would suggest that if you can your posts should be removed from the internet by close of business today..or make a statement withdrawing your comments if the first option is not possible.. I have absolutely no issues in creating a case here and should any buyer refer to a posts made by you or your possy on this or any other internet platform then expect some recourse without any further notification.
