Anybody have any idea why this would not have been repaired?

With a rear-ender, there is a good chance the chassis is crumpled.
I would imagine that Am may not be happy about supplying a replacement outside of the dealer network.

It may be that it's a confiscated car and the rules preclude fixing and selling?

AML won't sell a V/H tub to anyone. If the chassis needs to be fixed it's back to Gaydon for re-manufacture. Take it to bits and rebuild on a new tub.

When I enquired about this a few years back I never got a straight answer to the question "have you done this before?"...

One can visualise a club hammer repair shop might get to work on this one. Quoted ref. SCFLCCFP9EG. It does not look too bad in the photos, although if the tailgate is out of line, that could be tricky.

A new back panel on that car (might need to make a few spacers to make it fit), and there you go Sir. Proper job.
