The car in question is actually not been in a good state as have had to have new clutch new ball joints new shockers on front new nox sensor flexi plus welding and other things i cant remember we are currently taking the garage we bought it from to court as he wont pay for any parts even though we only bought a month ago. Thanks for any help.

Under this circumstances I would be looking to reject the car.

Assuming it's an E90/1/2/3, 318i diff failure is common. Well, they just wear out and howl like a bd. A 320d diff will require a different prop and also driveshafts. 320d diffs have a Giubo (rubber coupling) and each end of the prop, 318i/320i's have a four bolt metal to metal prop/diff joint.

I've got a couple of 318i diffs here. Possibly a prop as well. Dunno about driveshafts but they're cheap enough used.
