GA6L45R 6 transmission issues

Start the car and part of the selector mechanism starts clicking under the leather shift boot. When it does this, it causes the revs to dip and also the P indicator on the dash to momentarily (0.5 second) dissapear.
Then it throws the ESP and Brake warning light on.
If I hold the revs at higher than idle speed (say 1200-1500 rpm) the issues stops.
And after doing this for a while the car seems to settle.down and can be driven.
But then if I come to a stop or slow right down,.for a junction or round a bout. The car will jump out of gear (it just revs out momentarily) before engaging gear again.
I'd imagine this is going from 2nd gear to 3rd.gear?
On a stretch of road it works fine,.until I do something like engage kickdown at the point the ESP and Brake warning light will.come on and I have to pull over and turn the car off and then on again
I have changed the battery and checked to see if transmission fluid level was ok (using the correct procedure to do so) level seemed good but transmission fluid was very very dark brown and almost watery in viscosity as it initially trickles out of fill hole.
So,.I have ordered a new transmission filter kit and ATF and I'll chenage the fluid.
But would poor fluid condition cause all.the.issues I have at initial cold start when car is stationary?
