Traction Control Problem

A friend has a 2004 320d and the traction control does not want to turn off. When he presses the button the light goes off but the TC stays on. Any ideas whats wrong or how to fix it. Cheers

Press the DSC button *briefly*....the yellow triangle is illuminated, DSC is disengaged, limited wheelspin is allowed, but traction control is still present.

Press the DSC button for 5 seconds:
Yellow triangle lit, yellow BRAKE light illuminated, DSC *and* traction control disengaged

then all hell breaks loose, well maybe not in a 320d
