I assume this comes with RFT tyres - and does anyone else think this price a bit high?

+1. No matter what the salesman says its a year old in a few days. I would be surprised if you couldnt buy one new and therefore registered 2010 for that price. I'd say you could get 10% off a new one.

Heres a similar car for £3,600 less.

Agreed. Go to your local dealer and see what they can offer you on a brand new example.

Not true - the listing shows it was registered in July '09, so just coming up to half that.

I meant that ultimately the car is a 2009 car, and we're just about to move into 2010, and its seriously overpriced in that context.

I think if you could get it down to £32k it would be fair, it has the DCT gearbox and the new iDrive, however there is no decent sound system, which for me means I would walk.

32 seems more reasonable for me - I want DCT and the car has been on there for a while so will give them a call

That's likely to be either a BMW/Dealer Management Car or a Demonstrator; maybe both. The deals they get on either source also make it overpriced for me. It's also a thirsty car so unlikely to sell fast. I'd bargain about 5-3k down on asking price - the next few weeks are slow selling times and the salesmen have Christmas to pay for. Be ruthless!
