Hi all, I got ttted on the way home from work the other night. To cut a long story short, I was filtering between lanes one and two (approaching a slip road to take the exit) on a major A road. The traffic was crawling along at maybe 5-10 mph. A car pulled out of lane two to get into lane one while I was alongside. He wasn't indicating. Got ttted but managed to stay on. No injuries or damage to bike apart from a sheared foot peg and a bent rear brake leaver. Lucky I know. The Audi has got 4 big gouges along the rear passenger door caused by my footpeg, brake leavers and bar end. Audi man has lied through his teeth and said he was driving along minding his own buisness when out of no where I rode straight into him, although he couldn't have been nicer at the side of the road. Does any one know what the likely outcome will be? Thanks.

Depends whose insurance company blinks first, but probably 50-50.

What you can do to sway things in your favour a little bit is get down to your GP and get signed off from work and lots of painkillers for all the aches and pains caused by the injuries you suffered when he side-swiped you.
Obviously let your own insurer know you are now looking at personal injury too...

None of that will sway it in his way one little bit.

You might be surprised.

Just a shame Loon (or one of his alter-egos) isn't here any more...

When I got pushed over by a car exiting a side road, my own insurance company asked me if I was filtering (at the point of the accident I wasn't, and the full claim went I my favour) but he said that if I had been it would have altered the decision. I'm going to guess 50:50 will be your best outcome.

In my experience a 50-50 is the same as an at fault in terms of impact to your future prices. I worked for RSA when I was a student and this was the case then, at least for them.

I'd suggest contacting one of the bike specific solicitors and asking them. Filtering is allowed and mentioned in Highway Code so reasonable chance you'll be OK

Glad you're ok but crap that the driver is now lying about the events.

It's been a while since I was last involved in anything but I've always made the call to my insurance company at the side of the road straight after the accident. The other party has always given the straight story as they haven't had time to think about coming up with a different turn of event and I've always passed the phone to them to give their details and explanation as it's all recorded. This has meant I've never had any issues down the line.

Doesnt really matter what you say at the scene of accident these days , dash cam is the answer, saved me. Insurance excess's and no claims is such a big deal persons will do anything to avoid etc.

Thanks for the replies fellas. Looks like 50/50 is the likely outcome then. Goodbye no claims and excess.

Isn't it, there's a full snowstorm of snowflakes in PH BB. I don't think he's bothered though as he's suning himself abroad until next year.

Insurance isn't everything.

I know a guy who was a burglar when he was younger, he said what stopped him was when his mum's house was done by someone, not that he'd been inside twice already and knew the sentences would only get longer. He still says that going to jail was exactly like the speech at the start of Porridge - an occupational hazard.

Even though his mum had insurance to cover everything that was stolen or broken it was the fact that they had gone through everything and treated his mums stuff with total disrespect and how upset she had been by it that stopped him; it was the first time he had taken the effect of his own actions on board.

He said that before that he and his mates had done some pretty crazy stuff in other people's houses, partly for a laugh, partly to relieve nerves; torn up photographs, put mummy's vibrators under the kids pillows or in their toy-boxes, st in pot-plants, wked in kettles or milk in the fridge, even stuffed people's toothbrushes up his arse.
I still don't think he's really sorry for what he did, but at least he isn't doing it any more.

Much as Loon has pissed me off over the years, I probably wouldn't do any of that to him!

Or would I...?

hehe
