Insurance holding back my NCB

About 3 months ago I had an accident where a tourist (looking in the wrong direction) pedestrian stepped out in front of me. I hit him, came off the bike and ended up a broken arm and smashed bike - against his bruised arm & a scrape on his leg.
My insurance company didn't try to claim against the pedestrian on the basis that he's a foreigner and it would be too much grief. As I only have TPFT, the repair bill was mine.
Now that I've come up for renewal of my insurance, even though there hasn't been a claim, they are only giving me 1 years NCB when it should have been 4 years on the basis that this pedestrian could still make a claim. As the insurance company want to leave the cash open for 6 months until they will re-instate the NCB back to 4 years, I am left with only being able to renew with competitors at 1 year NCB and kiss goodbye to the rest of it. If I stay with the same company, then they will refund me the difference in premium (at their renewal price) and give me the full NCB at renewal next period.
It seems like I'm being had over a barrel here. No claim has been made, but I'm being hit on NCB. No attempt at recovery from the person whose fault it was, and an overinflated premium being the only way that I can hang on to the NCB.
Any advice?

This is typical insurance company. I would try and get a good quote with the 1 year no claims, alternatively swallow your pride and just stay with them. I had the same problem with my house insurance. Came off the bike smashed helment and fcuked my leathers up so called up to claim. I did not have the personal possesion cover out of the home so i could not claim. Ok no problem. My renewall just came through and they are charging me more because i would have made a claim if i could. I tried explaining that i did not make a claim but that did not matter.
If you look at the small print is probably all insurance policies it will ask you if you have made a claim or had a loss insured or uninsured in the last 12 months. Technically we have probably all had a loss, dropped and broken a mobile phone, camera knocked into another car and done it out of the insurance, apparently we are meant to tell them.

Technically we have probably all had a loss, dropped and broken a mobile phone, camera knocked into another car and done it out of the insurance, apparently we are meant to tell them.

Insurance companies seem to be getting really tight. I guess they are taking a pasting from all the personal claims. My bike was whisked off to the "Prefered Repairer" earlier in the year - i wouldn't recommend it. Second-hand, resprayed parts, missing decals - heat shield missing leading to the paint bubbling on the belly-pan, and a mirror that came off in the delivery drivers hand when he delivered it back - and that was after 6 weeks of calls. In all fairness they have replaced the belly-pan panel with a Yamaha one and the mirror...
Just went through the same thing with a claim on damage to a PVC window frame in my house. Got a quote from Everest to replace it as they fitted them all 4 years ago - £1600. Lloyds said "no way. We can repair it cheaper" - sent round some monkey who filled the burn-hole then sprayed off-white spray-paint over the filler - nice! Would I now give him the £50 excess??? errrr No!
That seems completly unreasonable to me - you haven't made a claim, so how can you loose your NCB???
There doesn't seem to be anything you can do except vote with your feet/wallet mate. The trouble is you don't realise how good/bad the insurance company is until you make a claim (or not in your case!)
