Witness To Crash Sues Dead Victim
A biker who claims he was traumatised when he saw a fatal road accident is seeking compensation - from the rider who died. Ken Smith is suing the dead biker's estate for £150,000 over the incident - in which he dislocated his thumb - claiming the victim was going too fast. Georgina Howells, fiancee of the man who died and mother to two of his children, said Mr. Smith, 37, was 'being greedy and milking it for what he can'. Lawrence Brown, 42, died on August 1, 2004, in Ashurst, Sussex, while out riding with eight others - including Mr. Smith. Mr. Brown swerved to avoid a horse lorry coming round a bend but left the road and hit a tree. A coroner returned an accidental death verdict. Miss Howells, 29, from Maidenhead in Berkshire has launched a rivel claim against Mr. Smith, from Barras in the Scottish Borders.

Smiler.

Very sad. There seems to be more to this though, a right damage-fest. Only winners will be the lawyers.

How can you be responsible for someones accident when you are behind them? Sounds like a counter-claim to me, as said lawyers will be the only winners.

Sad.

Sounds like Ambulance chasers Lawyers4crashes have decided its best to sue everyone, the simple rule of the road of not going faster than your braking distance to can see seems to have been shot to sh*t.
