Do you know if there is a catalyst in there currently? It's quite common for people to take the cat out (to increase the noise) and this can cause emissions problems.
Also, bear in mind that there is both a cat (catalyst) and a pair of pre-cats. I think I'm right in saying the pre-cats are only used during warm up. So if the pre-cats have been damaged or removed on your car you may find it passes the test when warm, but not if tested from cold? Just a thought...

my car comes from the island of Jersey and is no Cat. no cat in the exhaust and ECU: 4.0L no cat ... I changed the ECU for a 4.0L normal but the car is not running well, the engine coughs ....
by cons, you tell me that hot, I just do without the pre-cat and keep only the CAT in the exhaust Y??
