I have an 08 Defender and I had a letter today about a second safety recall on the handbrake. The turbo to intercooler pipe has just started blowing so I thought they may as well fix that whilst it's there.

We'd need to run a diagnostic test first, £122. I point out I don't need a diagnostic test - the pipe has a hole in it, it's clearly visible, it's self diagnosed! It's also exactly the same fault as was fixed under warranty, there is a design fault and the steering UJ rubs on the pipe. Still wont do it. Phone LR 'customer services', they confirm that the dealer is right otherwise they would be accountable for other faults. I point out that they didn't do a diagnostic for the same fault when it occurred under warranty, when they would have had to pay for any additional faults. Still no movement.

So I've ordered the part and will fit it myself, am I right to be annoyed or do they have a point?

Sounds annoying, but it's probably some BS they have to run through in case there is something else wrong with the engine which you will then try and say they did whilst they were replacing the pipe.

My wife's Alfa wore a hole in it's intercooler pipe on a gearbox stud. Common problem. I was able to twist the pipe away from the stud slightly to give more clearance if that makes sense. Not sure if that's possible on yours bit it might be worth a look when you are under there.

That is not acceptable.
I would be kicking off in good style.
The part shouldn't have gone once in that time let alone twice, so is obviously substandard or a design fault. They can't fix a problem under warranty, then wash their hands of it.

Lets say the problem was fixed on the final day of warranty. If the part fails within a reasonable time after that, they are still liable even though the warranty has expired. (a reasonable time in my book would be at least 3 years after the date the replacement was fitted)

I would be approaching it from that angle. I would also try Land Rover again - you may get a more reasonable employee.
