Hi all,

Without going into detail, I have a nice sideline with a website which gives me a few extra quid/mth from advertising revenue.

Someone has started doing essentially the exact same thing, with a similar trading name (completely different Ltd Co name). We don't have a physical product as such, it's more of a service which again, they supply the exact same.

Would we say this is competition, or something actionable? (However it's not really worth me doing that).

Have either of you got a trademark that the other is infringing?

It would appear not. He's displaying the Copyright 'C', but a search of the Gov site yields nothing.

that is only registered trademarks - you could have a breach of trademark even if it is not registered...
if you were first and the name you use is a trademark (ie not something obvious like bobs motr parts and you are both called bob) then you could contact him and ask him to change name as he is in breach of your trademark... however enforcing it might be a challenge... and ultimately if he changes name he will still compete...

the only reason for doing it is if you think that folks might go to his website thinking it is yours...
