We have next door to us 4 x "holiday cottages"

They haven't been used for 4 years though that doesn't make a difference, they had full planning permission and all signed off converted from old farm buildings.

The planning restrictions are no one person can stay in them for longer than 3 months in any 12 though they can be let 365 days per year.

Where do these stand with stamp duty? Would they be commercial or buy to let? it does make a big difference to stamp duty if they are buy to let.

I'm pretty sure that the Stamp Duty on these would be the same as for any residential property - whether a home, a buy to let or a holiday home.

I fear the same, here's the restriction preventing them from been residential?

The cottages shall be occupied for holiday purposes only and shall not be occupied as a persons' sole or main place of residence. The owners/operators of the site shall maintain an up-to-date register of the names of all owners/occupiers of accommodation on the site, and of their main home addresses, and shall make this information available to the Local Authority.

No one shall occupy the holiday cottages in excess of a total of three calendar months in any year provided that and without prejudice to the foregoing once the holiday cottages have been occupied by a person or persons for a total of three calendar months in any year then that person or persons shall not occupy again any holiday cottage on the site until an interval of at least two months has elapsed from the date of expiry of the said three month period.

I don't think this makes any difference regarding Stamp Duty.
